1. ÂMBITO, CELEBRAÇÃO DO CONTRATO E COMUNICAÇÃO DAS CLÁUSULAS
1.1 Os presentes Termos regem a cedência de utilização de unidades de alojamento local exploradas pela Short Conclusion, Lda. (adiante «The Haus»), bem como todos os serviços acessórios prestados ao hóspede nesse contexto.
1.2 O contrato de alojamento considera-se celebrado com a aceitação, pela The Haus, do pedido de reserva do hóspede. A confirmação pode ser prestada por escrito ou por correio eletrónico. Nas reservas efetuadas através de plataformas em linha (OTA) aplicam-se adicionalmente as condições tarifárias e de cancelamento aí divulgadas; na relação entre o hóspede e a The Haus prevalecem os presentes Termos, salvo regra imperativa da plataforma em sentido diverso.
1.3 A The Haus presta exclusivamente serviços de alojamento local e serviços acessórios diretamente conexos. Não organiza nem intermedeia viagens organizadas nem serviços de viagem conexos na aceção do Decreto-Lei n.º 17/2018.
1.4 A subcedência ou o subarrendamento da unidade, bem como a sua utilização para fim distinto do alojamento, carecem de autorização prévia e escrita da The Haus.
1.5 Não são aplicáveis condições divergentes propostas pelo hóspede que não tenham sido expressamente aceites por escrito pela The Haus.
1.6 Comunicação e informação. Nos termos dos artigos 5.º e 6.º do Decreto-Lei n.º 446/85, de 25 de outubro, os presentes Termos são comunicados ao hóspede na íntegra, de modo adequado e com antecedência, antes da submissão do pedido de reserva, e são novamente disponibilizados no momento do registo de entrada, encontrando-se permanentemente acessíveis e descarregáveis em www.the-haus.co/terms. A The Haus presta os esclarecimentos que razoavelmente lhe sejam solicitados sobre qualquer cláusula, através de reservations@the-haus.co. Chama-se especialmente a atenção do hóspede para as cláusulas 2 (inexistência de direito de livre resolução), 6 (cancelamento e não comparência) e 10 (danos e encargos adicionais).
2. INEXISTÊNCIA DE DIREITO DE LIVRE RESOLUÇÃO
Tratando-se de contrato de prestação de serviços de alojamento para fim não residencial com data ou período de execução determinados, não assiste ao hóspede o direito de livre resolução, nos termos do artigo 17.º, n.º 2, alínea l), do Decreto-Lei n.º 24/2014, de 14 de fevereiro. Aplicam-se exclusivamente as condições de cancelamento da tarifa reservada (cláusula 6).
3. PREÇOS, PAGAMENTO E GARANTIA
3.1 Os preços são indicados em euros e incluem o IVA à taxa legal em vigor (alojamento à taxa reduzida, serviços acessórios e produtos adicionais à taxa normal). Alterando-se as taxas legais, o preço altera-se em conformidade.
3.2 Os preços aplicam-se por unidade e por noite, para a ocupação reservada. Pessoas adicionais, camas suplementares, taxa de limpeza, taxa de animais e demais produtos são faturados autonomamente e discriminados.
3.3 A taxa municipal turística de dormida do Município de Lisboa é devida por hóspede e por noite, nos termos e limites do regulamento municipal em vigor, e é cobrada em acréscimo ao preço, salvo quando expressamente indicada como incluída.
3.4 O pagamento é devido nos termos da tarifa reservada. A The Haus pode, a todo o tempo, exigir a indicação de um cartão de crédito válido como garantia do contrato, bem como verificá-lo ou pré-autorizá-lo.
3.5 Autorização de débito. Ao aceitar os presentes Termos, o hóspede autoriza expressamente a The Haus a debitar o cartão indicado pelo preço devido, encargos de cancelamento, valor devido por não comparência e pelos montantes previstos na cláusula 10.
3.6 As faturas vencem-se de imediato. Em caso de mora aplicam-se os artigos 804.º e seguintes do Código Civil e os juros legais em vigor.
3.7 A compensação de créditos pelo hóspede só é admitida quanto a créditos não contestados ou judicialmente reconhecidos.
4. ENTRADA, SAÍDA, ACESSO E OBRIGAÇÕES DE REGISTO
4.1 A unidade fica disponível a partir das 16:00 do dia de entrada e deve ser desocupada até às 12:00 do dia de saída. Após esse momento aplicam-se os montantes da cláusula 10 e, sendo caso disso, uma noite adicional.
4.2 No momento da entrada, o hóspede identifica-se mediante documento oficial de identificação válido com fotografia. Tratando-se de cidadão estrangeiro, a The Haus está legalmente obrigada a comunicar o boletim de alojamento através do sistema SIBA, no prazo de três dias úteis, nos termos dos artigos 15.º a 17.º da Lei n.º 23/2007, de 4 de julho. A recusa de apresentação de documento válido impede a formalização do alojamento.
4.3 O acesso é assegurado por chave digital (mobile key / PIN) e/ou cartão. As credenciais são pessoais e intransmissíveis; a sua cedência a terceiros é proibida. A perda deve ser comunicada de imediato; a substituição é faturada nos termos da cláusula 10.
4.4 Não se verificando a entrada até às 23:59 do dia de chegada, e não tendo sido acordada chegada posterior, a The Haus pode dispor da unidade; o preço mantém-se devido nos termos da cláusula 6.4.
4.5 Só podem pernoitar na unidade as pessoas identificadas na reserva. Verificando-se ocupação superior, a The Haus pode recusar o acesso ou faturar a ocupação adicional nos termos da cláusula 10.
4.6 O contrato é celebrado exclusivamente com maiores de 18 anos. Os menores só são alojados quando acompanhados por quem exerça as responsabilidades parentais ou mediante autorização escrita comprovada.
5. SERVIÇOS, ALTERAÇÕES E ALOJAMENTO ALTERNATIVO
5.1 As fotografias e descrições têm caráter ilustrativo; diferenças de pormenor entre unidades da mesma tipologia não constituem desconformidade.
5.2 O alojamento é prestado sem refeições, salvo reserva expressa em contrário.
5.3 Os pedidos de alteração carecem de aceitação pela The Haus e podem implicar ajuste de preço segundo a tarifa em vigor à data da alteração, podendo ser tratados como cancelamento seguido de nova reserva quando a tarifa original assim o preveja.
5.4 Alojamento alternativo. Ficando a unidade reservada indisponível por causa não imputável à The Haus, esta pode disponibilizar alojamento equivalente ou superior em Lisboa, suportando o diferencial de preço e os custos razoáveis de transferência. Mantêm-se integralmente os direitos legais do hóspede.
6. CANCELAMENTO PELO HÓSPEDE E NÃO COMPARÊNCIA
6.1 O cancelamento é comunicado por escrito (reservations@the-haus.co) e produz efeitos com a receção.
6.2 Aplicam-se as condições de cancelamento da tarifa reservada, divulgadas no processo de reserva e constantes da confirmação. As tarifas não reembolsáveis não conferem direito a reembolso.
6.3 Nas tarifas flexíveis, o cancelamento é gratuito até ao prazo indicado na confirmação. Após esse prazo, é devido o preço acordado, deduzidas as despesas evitadas e o valor obtido com nova colocação da unidade; em alternativa, é devido o encargo de cancelamento indicado na tarifa. Mantém-se a faculdade de o hóspede demonstrar dano inexistente ou inferior.
6.4 Não comparência: não se verificando a entrada nem tendo havido cancelamento, é devido o preço da totalidade da reserva e, no mínimo, o da primeira noite, nos termos da cláusula 6.3.
6.5 Nas reservas efetuadas através de OTA aplicam-se as condições de cancelamento e de pagamento vinculativamente acordadas nessa plataforma.
7. RESOLUÇÃO PELA THE HAUS
7.1 A The Haus pode resolver o contrato com justa causa quando: (a) não seja prestado o pagamento antecipado ou a garantia de cartão, apesar de interpelação com prazo; (b) ocorra caso fortuito ou de força maior que impossibilite a prestação; (c) a reserva assente em declarações falsas ou enganosas sobre factos essenciais (identidade, solvabilidade, finalidade da estadia); (d) existam motivos sérios para crer que a utilização põe em risco o funcionamento, a segurança ou o bom nome da The Haus, designadamente eventos não declarados, uso comercial ou subcedência; (e) o hóspede viole obrigações essenciais do Regulamento Interno e não seja exigível a continuação da estadia.
7.2 Verificando-se resolução fundada nas alíneas (c) a (e), mantém-se o direito ao preço relativo à totalidade do período reservado, sem prejuízo do direito a indemnização.
8. REGULAMENTO INTERNO E OBRIGAÇÕES DO HÓSPEDE
8.1 O hóspede obriga-se a usar a unidade com o cuidado devido e a cumprir o Regulamento Interno, bem como o regulamento do condomínio na parte que lhe seja aplicável.
8.2 Período de descanso entre as 22:00 e as 07:00. Deve evitar-se ruído suscetível de perturbar outros hóspedes ou a vizinhança.
8.3 É absolutamente proibido fumar em todas as áreas interiores, incluindo escadas, corredores e demais partes comuns, abrangendo cigarros eletrónicos. As infrações são faturadas nos termos da cláusula 10.3.
8.4 Festas e eventos de qualquer natureza carecem de autorização prévia e escrita.
8.5 Animais de companhia só são admitidos mediante autorização prévia e escrita e contra pagamento da taxa de 20 € por animal e por noite, sendo admitido um cão por unidade. Não são aceites gatos nem outros animais. Os cães de assistência, nos termos do Decreto-Lei n.º 74/2007, estão isentos de taxa e de autorização prévia. Os animais introduzidos sem autorização são faturados nos termos da cláusula 10.3.
8.6 É proibida a utilização de aparelhos elétricos trazidos pelo hóspede que não sejam de uso pessoal corrente, bem como de chama viva, velas, aquecedores portáteis e grelhadores. Os detetores de fumo e demais equipamentos de segurança não podem ser tapados, removidos ou manipulados.
8.7 O hóspede responde pelos danos causados por si, pelos seus acompanhantes ou por terceiros a quem tenha facultado o acesso, nos termos dos artigos 483.º, 798.º e 799.º do Código Civil. Havendo pluralidade de hóspedes na mesma reserva, a responsabilidade é solidária (artigos 512.º e 513.º do Código Civil).
8.8 Danos e avarias devem ser comunicados de imediato, de modo a permitir a reparação. A falta culposa de comunicação preclude, nessa medida, o direito a redução do preço.
9. RESPONSABILIDADE DA THE HAUS
9.1 A The Haus responde nos termos gerais de direito pelos danos causados por facto que lhe seja imputável, não sendo excluída nem limitada a responsabilidade por dolo ou culpa grave, nem a responsabilidade por danos causados à vida, à integridade física ou à saúde.
9.2 A responsabilidade por objetos introduzidos na unidade rege-se pelos artigos 1946.º e seguintes do Código Civil. Recomenda-se a guarda de valores no cofre, quando disponível.
9.3 Por perturbações resultantes de caso de força maior, greve, determinação de autoridade, ou falha de eletricidade, água, aquecimento, elevador, rede sem fios ou sistemas de acesso, a The Haus responde apenas havendo culpa. A interrupção de curta duração da rede sem fios não confere direito a redução do preço.
9.4 Objetos perdidos são conservados durante três meses e reenviados, a pedido, a expensas e risco do hóspede.
10. DANOS, ENCARGOS ADICIONAIS PRÉ-LIQUIDADOS E DÉBITO NO CARTÃO
10.1 Princípio. O hóspede responde pelos danos causados na unidade, no seu recheio e nas partes comuns, por si ou por pessoas a quem tenha facultado o acesso, nos termos dos artigos 483.º, 798.º e 799.º do Código Civil. Havendo pluralidade de hóspedes, a responsabilidade é solidária. A responsabilidade pelo dano efetivamente verificado não está sujeita a qualquer limite máximo.
10.2 Âmbito do dano. São ressarcíveis, designadamente, os custos de reparação, de substituição, de limpeza especializada e de desinfeção, os custos de averiguação do dano e o lucro cessante correspondente às noites em que a unidade não possa ser colocada no mercado em consequência do dano (artigo 564.º, n.º 1, do Código Civil), calculado pelo preço médio líquido por noite da tipologia afetada nos 30 dias anteriores.
10.3 Encargos adicionais pré-liquidados. Para as situações abaixo, a The Haus cobra os seguintes montantes, que correspondem a uma liquidação prévia e razoável do dano típico e não a cláusula penal:

10.4 Regime dos montantes. Os montantes da cláusula 10.3 são sempre imputados ao dano efetivo apurado nos termos das cláusulas 10.1 e 10.2, não se acumulando com este. Mantém-se expressamente a faculdade de o hóspede demonstrar que o dano não ocorreu ou foi de valor inferior, caso em que apenas é devido o valor demonstrado, e a faculdade de a The Haus demonstrar dano superior e exigir a diferença. Os montantes são, em qualquer caso, suscetíveis de redução equitativa nos termos do artigo 812.º do Código Civil.
10.5 Débito no cartão. O hóspede autoriza a The Haus a debitar o cartão indicado pelos montantes devidos ao abrigo das cláusulas 10.1 a 10.3. Antes do débito, a The Haus comunica ao hóspede, por escrito, o facto, o montante e a respetiva base de cálculo, remetendo os elementos de prova disponíveis (fotografias, orçamentos, faturas) e concedendo prazo para pronúncia. Não sendo o valor ainda determinável, é comunicada a existência do dano e a quantificação é remetida posteriormente. Cada débito é acompanhado de fatura ou documento equivalente.
10.6 Documentação. A The Haus pode documentar danos e infrações mediante registo fotográfico e autos, e utilizar esses elementos para exercício de direitos e perante seguradoras e autoridades, nos termos descritos na secção 8 da Política de Privacidade.
10.7 Caução. Em casos determinados — designadamente reservas de grupo, estadias prolongadas ou risco acrescido — a The Haus pode exigir caução ou pré-autorização até 500 € por estadia. A libertação ocorre no prazo de 7 dias após a saída, não existindo créditos pendentes.
10.8 Direitos do hóspede. O hóspede pode contestar qualquer débito. Mantêm-se integralmente os seus direitos perante o emitente do cartão, o Livro de Reclamações Eletrónico e as vias judiciais.
11. PROTEÇÃO DE DADOS
11.1 Os dados pessoais são tratados nos termos do Regulamento (UE) 2016/679 e da Lei n.º 58/2019, de 8 de agosto.
11.2 As finalidades, fundamentos, destinatários, prazos de conservação e direitos dos titulares constam da Política de Privacidade, disponível em www.the-haus.co/privacy-policy.
11.3 Os dados de cartão são tratados exclusivamente através de prestadores certificados PCI-DSS e não são armazenados em texto legível pela The Haus.

12. PROPRIEDADE INTELECTUAL E UTILIZAÇÃO DO SÍTIO
12.1 Os conteúdos do sítio e do motor de reservas estão protegidos por direito de autor e por direito de marcas. A sua utilização para além da reserva contratada carece de autorização escrita.
12.2 É proibido o acesso automatizado ao sítio e ao motor de reservas (scraping, robôs, ferramentas de recolha).
12.3 O hóspede é responsável pela confidencialidade das suas credenciais de acesso.
13. RECLAMAÇÕES E RESOLUÇÃO DE LITÍGIOS
13.1 As desconformidades devem ser comunicadas de imediato, no local, de modo a permitir a sua correção.
13.2 As reclamações posteriores devem ser apresentadas por escrito para info@the-haus.co no prazo de 20 dias úteis após a saída, sem prejuízo dos prazos legais de prescrição.
13.3 Livro de Reclamações Eletrónico. Nos termos do Decreto-Lei n.º 156/2005, de 15 de setembro, o hóspede pode apresentar reclamação através do Livro de Reclamações Eletrónico, em www.livroreclamacoes.pt.
13.4 Resolução alternativa de litígios. Nos termos do artigo 18.º da Lei n.º 144/2015, de 8 de setembro, informa-se que, em caso de litígio de consumo, o consumidor pode recorrer ao Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL), www.centroarbitragemlisboa.pt, ou ao Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (CNIACC), www.cniacc.pt. A The Haus não aderiu previamente a qualquer entidade de resolução alternativa de litígios, salvo nos casos de arbitragem necessária impostos por lei.
14. DISPOSIÇÕES FINAIS
14.1 As alterações ao contrato carecem de forma escrita.
14.2 As condições especiais individualmente acordadas por escrito prevalecem sobre os presentes Termos.
14.3 A invalidade de qualquer cláusula não afeta a validade das restantes, sendo a cláusula inválida substituída pelo regime legal supletivo aplicável.
14.4 Lei aplicável: lei portuguesa. Sendo o hóspede consumidor com residência habitual noutro Estado, mantêm-se aplicáveis as disposições imperativas de proteção do consumidor desse Estado.
14.5 Competência judiciária: aplicam-se as regras legais de competência. Não é estipulado qualquer pacto de foro em prejuízo do consumidor.
14.6 Os presentes Termos estão disponíveis em português e em inglês. Em caso de divergência, prevalece a versão portuguesa.
DECLARAÇÃO DO HÓSPEDE
O hóspede declara que lhe foram integralmente comunicados, com antecedência e de modo adequado, os presentes Termos e Condições e o Regulamento Interno, que os leu, compreendeu e aceita, e que tomou conhecimento da Política de Privacidade — em especial das cláusulas 2 (inexistência de direito de livre resolução), 6 (cancelamento e não comparência) e 10 (danos e encargos adicionais pré-liquidados), cujo conteúdo lhe foi expressamente assinalado.

This is a courtesy translation. In the event of any discrepancy, the Portuguese version of these Terms shall prevail.
1. SCOPE, FORMATION OF THE CONTRACT AND COMMUNICATION OF TERMS
1.1 These Terms govern the provision of local accommodation units operated by Short Conclusion, Lda. (hereinafter "The Haus"), together with all ancillary services provided to the Guest in that context.
1.2 The accommodation contract is formed when The Haus accepts the Guest's booking request. Confirmation may be given in writing or by e-mail. For bookings made through online travel agencies (OTAs), the rate and cancellation conditions displayed there apply in addition; as between the Guest and The Haus these Terms prevail, except where mandatory platform rules override them.
1.3 The Haus provides local accommodation services only, together with directly related ancillary services. It neither organises nor brokers package travel or linked travel arrangements within the meaning of Decree-Law no. 17/2018.
1.4 Subletting or re-letting the unit, and any use for purposes other than accommodation, require the prior written consent of The Haus.
1.5 Deviating terms proposed by the Guest do not apply unless expressly accepted in writing by The Haus.
1.6 Communication and information. Pursuant to Articles 5 and 6 of Decree-Law no. 446/85 of 25 October, these Terms are communicated to the Guest in full, adequately and in good time, before the booking request is submitted, and are made available again at check-in; they are permanently accessible and downloadable at www.the-haus.co/terms. The Haus provides any clarification reasonably requested on any clause, via reservations@the-haus.co. The Guest's attention is expressly drawn to clauses 2 (no right of free withdrawal), 6 (cancellation and no-show) and 10 (damages and additional charges).
2. NO RIGHT OF FREE WITHDRAWAL
As this is a contract for accommodation services for non-residential purposes with a specific date or period of performance, the Guest has no right of free withdrawal, pursuant to Article 17(2)(l) of Decree-Law no. 24/2014 of 14 February. Only the cancellation conditions of the booked rate apply (clause 6).
3. PRICES, PAYMENT AND SECURITY
3.1 Prices are stated in Euro and include VAT at the statutory rate in force (accommodation at the reduced rate; ancillary services and additional products at the standard rate). Should statutory rates change, prices change accordingly.
3.2 Prices apply per unit per night for the booked occupancy. Additional persons, extra beds, cleaning fee, pet fee and other products are invoiced separately and shown as such.
3.3 The municipal tourist accommodation tax of the Municipality of Lisbon is payable per guest per night, under the terms and limits of the municipal regulation in force, and is charged in addition to the price unless expressly stated as included.
3.4 Payment is due according to the booked rate. The Haus may at any time require a valid credit card to secure the contract, and verify or pre-authorise it.
3.5 Charging authorisation. By accepting these Terms, the Guest expressly authorises The Haus to charge the card provided for the price due, cancellation charges, the amount due for non-arrival, and the amounts set out in clause 10.
3.6 Invoices fall due immediately. In the event of late payment, Articles 804 et seq. of the Civil Code and the statutory interest rate in force apply.
3.7 Set-off by the Guest is admissible only in respect of undisputed or judicially recognised claims.
4. ARRIVAL, DEPARTURE, ACCESS AND REGISTRATION DUTIES
4.1 The unit is available from 16:00 on the day of arrival and must be vacated by 12:00 on the day of departure. Thereafter the amounts in clause 10 apply and, where applicable, a further night.
4.2 On arrival the Guest must present a valid official photo ID. Where the Guest is a foreign national, The Haus is legally required to submit the accommodation bulletin through the SIBA system within three working days, pursuant to Articles 15 to 17 of Law no. 23/2007 of 4 July. Refusal to present valid identification prevents the accommodation from proceeding.
4.3 Access is provided by digital key (mobile key / PIN) and/or card. Credentials are personal and non-transferable; passing them to third parties is prohibited. Loss must be reported immediately; replacement is charged under clause 10.
4.4 If the Guest does not arrive by 23:59 on the day of arrival and no later arrival has been agreed, The Haus may dispose of the unit; the price remains payable under clause 6.4.
4.5 Only the persons identified in the reservation may stay overnight. Where occupancy exceeds the booking, The Haus may refuse access or charge for the additional occupancy under clause 10.
4.6 The contract is concluded exclusively with persons aged 18 or over. Minors are accommodated only when accompanied by a person exercising parental responsibility or with documented written authorisation.
5. SERVICES, CHANGES AND ALTERNATIVE ACCOMMODATION
5.1 Photographs and descriptions are illustrative; minor differences between units of the same category do not constitute a lack of conformity.
5.2 Accommodation is provided without meals unless expressly booked otherwise.
5.3 Change requests require acceptance by The Haus and may result in a price adjustment at the rate in force on the date of the change; they may be treated as a cancellation followed by a new booking where the original rate so provides.
5.4 Alternative accommodation. If the booked unit becomes unavailable for reasons not attributable to The Haus, The Haus may provide equivalent or superior accommodation in Lisbon, bearing the price difference and reasonable transfer costs. The Guest's statutory rights remain unaffected.
6. CANCELLATION BY THE GUEST AND NO-SHOW
6.1 Cancellation must be notified in writing (reservations@the-haus.co) and takes effect upon receipt.
6.2 The cancellation conditions of the booked rate apply, as displayed during the booking process and stated in the confirmation. Non-refundable rates carry no entitlement to a refund.
6.3 For flexible rates, cancellation is free of charge until the deadline stated in the confirmation. Thereafter the agreed price is due, less expenses saved and less any income from re-letting; alternatively, the cancellation charge stated in the rate is due. The Guest remains free to prove that no damage, or lower damage, has occurred.
6.4 No-show: where the Guest does not arrive and has not cancelled, the price of the entire booking is due and, as a minimum, that of the first night, in accordance with clause 6.3.
6.5 For OTA bookings, the cancellation and payment conditions bindingly agreed on that platform apply.
7. TERMINATION BY THE HAUS
7.1 The Haus may terminate the contract with cause where: (a) advance payment or card guarantee is not provided despite demand with a deadline; (b) fortuitous event or force majeure makes performance impossible; (c) the booking rests on false or misleading statements as to essential facts (identity, solvency, purpose of stay); (d) there are serious grounds to believe that the use endangers the operation, security or reputation of The Haus, in particular undeclared events, commercial use or subletting; (e) the Guest breaches essential obligations of the House Rules and continuation of the stay cannot reasonably be required.
7.2 Where termination is founded on (c) to (e), the right to the price for the entire booked period is retained, without prejudice to any claim for damages.
8. HOUSE RULES AND GUEST OBLIGATIONS
8.1 The Guest must use the unit with due care and comply with the House Rules and, where applicable, the building's regulations.
8.2 Quiet hours from 22:00 to 07:00. Noise liable to disturb other guests or neighbours must be avoided.
8.3 Smoking is strictly prohibited in all indoor areas, including stairwells, corridors and common parts, e-cigarettes included. Breaches are charged under clause 10.3.
8.4 Parties and events of any kind require prior written consent.
8.5 Pets are admitted only with prior written consent and against payment of a fee of €20 per animal per night; one dog per unit is permitted. Cats and other animals are not accepted. Assistance dogs, under Decree-Law no. 74/2007, are exempt from both the fee and the consent requirement. Animals brought without consent are charged under clause 10.3.
8.6 Guest-supplied electrical appliances other than ordinary personal items, open flames, candles, portable heaters and barbecues are prohibited. Smoke detectors and safety equipment must not be covered, removed or tampered with.
8.7 The Guest is liable for damage caused by the Guest, their companions or third parties admitted by them, under Articles 483, 798 and 799 of the Civil Code. Where a booking covers several guests, liability is joint and several (Articles 512 and 513 of the Civil Code).
8.8 Damage and malfunctions must be reported immediately so that remedy can be provided. Culpable failure to report excludes, to that extent, any claim for price reduction.
9. LIABILITY OF THE HAUS
9.1 The Haus is liable under general law for damage caused by facts attributable to it. Liability for wilful misconduct or gross negligence, and liability for harm to life, physical integrity or health, is neither excluded nor limited.
9.2 Liability for property brought into the unit is governed by Articles 1946 et seq. of the Civil Code. Valuables should be kept in the safe, where available.
9.3 For disruptions arising from force majeure, strike, official orders, or failure of electricity, water, heating, lift, Wi-Fi or access systems, The Haus is liable only where at fault. A short-term Wi-Fi outage does not give rise to a claim for price reduction.
9.4 Lost property is kept for three months and forwarded on request at the Guest's cost and risk.
10. DAMAGES, PRE-LIQUIDATED ADDITIONAL CHARGES AND CARD DEBIT
10.1 Principle. The Guest is liable for damage to the unit, its contents and the common areas, caused by the Guest or by persons to whom the Guest granted access, under Articles 483, 798 and 799 of the Civil Code. Where several guests are on one booking, liability is joint and several. Liability for the damage actually incurred is not subject to any upper limit.
10.2 Scope of the damage. Recoverable heads include repair costs, replacement costs, specialist and disinfection cleaning, the cost of assessing the damage, and the loss of profit for nights during which the unit cannot be marketed as a result of the damage (Article 564(1) of the Civil Code), calculated at the average net nightly price of the affected category over the preceding 30 days.
10.3 Pre-liquidated additional charges. For the situations below, The Haus charges the following amounts, which constitute a reasonable advance liquidation of the typical damage and not a penalty clause:

10.4 Nature of the amounts. The amounts in clause 10.3 are always credited against the actual damage assessed under clauses 10.1 and 10.2 and are not cumulative with it. The Guest expressly retains the right to prove that no damage occurred or that it was lower, in which case only the amount proven is due; The Haus retains the right to prove higher damage and claim the difference. The amounts are in any event subject to equitable reduction under Article 812 of the Civil Code.
10.5 Card debit. The Guest authorises The Haus to charge the card provided with the amounts due under clauses 10.1 to 10.3. Before charging, The Haus notifies the Guest in writing of the facts, the amount and the basis of calculation, forwarding the available evidence (photographs, quotations, invoices) and allowing a period to respond. Where the amount is not yet determinable, the existence of the damage is notified and the quantification follows. Each debit is accompanied by an invoice or equivalent document.
10.6 Documentation. The Haus may document damage and breaches by photographic record and written reports, and use those materials to assert its rights and in dealings with insurers and authorities, as described in section 8 of the Privacy Policy.
10.7 Security deposit. In specific cases — group bookings, long stays or elevated risk — The Haus may require a deposit or pre-authorisation of up to €500 per stay, released within 7 days of departure where no claims are outstanding.
10.8 Guest's rights. The Guest may dispute any debit. The Guest's rights before the card issuer, the Electronic Complaints Book and the courts remain fully available.
11. DATA PROTECTION
11.1 Personal data is processed under Regulation (EU) 2016/679 and Law no. 58/2019 of 8 August.
11.2 Purposes, legal bases, recipients, retention periods and data subject rights are set out in the Privacy Policy at www.the-haus.co/privacy-policy.
11.3 Card data is processed exclusively through PCI-DSS certified providers and is not stored in readable form by The Haus.
11.4 Data protection contact: privacidade@the-haus.co.
12. INTELLECTUAL PROPERTY AND USE OF THE WEBSITE
12.1 The content of the website and booking engine is protected by copyright and trademark law. Use beyond the contracted booking requires written consent.
12.2 Automated access to the website and booking engine (scraping, bots, harvesting tools) is prohibited.
12.3 The Guest is responsible for the confidentiality of their access credentials.
13. COMPLAINTS AND DISPUTE RESOLUTION
13.1 Any lack of conformity must be reported immediately, on site, so that it can be remedied.
13.2 Subsequent complaints must be submitted in writing to info@the-haus.co within 20 working days of departure, without prejudice to statutory limitation periods.
13.3 Electronic Complaints Book. Under Decree-Law no. 156/2005 of 15 September, the Guest may submit a complaint through the Electronic Complaints Book at www.livroreclamacoes.pt.
13.4 Alternative dispute resolution. Under Article 18 of Law no. 144/2015 of 8 September, in the event of a consumer dispute the consumer may refer the matter to the Lisbon Consumer Dispute Arbitration Centre (CACCL), www.centroarbitragemlisboa.pt, or to the National Centre for Information and Arbitration of Consumer Disputes (CNIACC), www.cniacc.pt. The Haus has not previously adhered to any alternative dispute resolution body, save where mandatory arbitration is imposed by law.
14. FINAL PROVISIONS
14.1 Amendments to the contract require written form.
14.2 Special conditions individually agreed in writing prevail over these Terms.
14.3 The invalidity of any clause does not affect the validity of the remaining clauses; the invalid clause is replaced by the applicable statutory regime.
14.4 Governing law: Portuguese law. Where the Guest is a consumer habitually resident in another State, the mandatory consumer protection provisions of that State remain applicable.
14.5 Jurisdiction: the statutory rules on jurisdiction apply. No choice-of-forum clause is stipulated to the detriment of the consumer.
14.6 These Terms are available in Portuguese and English. In the event of discrepancy, the Portuguese version prevails.
GUEST DECLARATION
The Guest declares that these Terms and Conditions and the House Rules were communicated to them in full, in good time and adequately, that they have read, understood and accepted them, and that they have taken note of the Privacy Policy — in particular clauses 2 (no right of free withdrawal), 6 (cancellation and no-show) and 10 (damages and pre-liquidated additional charges), whose content was expressly drawn to their attention.

1. GELTUNGSBEREICH UND VERTRAGSSCHLUSS
1.1 Diese AGB gelten für die Überlassung von Apartments und Zimmern zur Beherbergung sowie für alle in diesem Zusammenhang für den Gast erbrachten weiteren Leistungen und Lieferungen von The Haus.
1.2 Der Beherbergungsvertrag kommt mit der Annahme des Buchungsantrags des Gastes durch The Haus zustande. Die Bestätigung kann in Textform (E-Mail) erfolgen. Bei Buchungen über Online-Reiseportale (OTA) gelten ergänzend die dort ausgewiesenen Tarif- und Stornobedingungen; im Verhältnis zwischen Gast und The Haus gehen diese AGB vor, soweit sie nicht von zwingend anwendbaren Regelungen der Plattform verdrängt werden.
1.3 The Haus erbringt ausschließlich Beherbergungsleistungen sowie unmittelbar damit verbundene Nebenleistungen. Es werden keine Pauschalreisen und keine verbundenen Reiseleistungen im Sinne der §§ 651a ff. BGB vermittelt oder veranstaltet.
1.4 Die Unter- oder Weitervermietung der überlassenen Unterkunft sowie ihre Nutzung zu anderen Zwecken als der Beherbergung bedürfen der vorherigen schriftlichen Zustimmung von The Haus.
1.5 Abweichende Bedingungen des Gastes werden nicht Vertragsbestandteil.
1.6 Einbeziehung. Diese AGB werden dem Gast vor Abgabe seines Buchungsantrags im Buchungsprozess sowie erneut bei der Anmeldung zur Verfügung gestellt und sind unter www.the-haus.co/terms jederzeit abrufbar und speicherbar.
2. KEIN WIDERRUFSRECHT
Bei Verträgen über die Beherbergung zu anderen Zwecken als zu Wohnzwecken, bei denen ein spezifischer Termin oder Zeitraum vorgesehen ist, besteht kein gesetzliches Widerrufsrecht (§ 312g Abs. 2 Nr. 9 BGB). Es gelten ausschließlich die vereinbarten Stornobedingungen des gebuchten Tarifs (Ziffer 6).
3. PREISE, ZAHLUNG, KAUTION
3.1 Preise in Euro, einschließlich gesetzlicher USt. (Beherbergung 7 %, Nebenleistungen 19 %). Bei Änderung der Steuersätze ändert sich der Preis entsprechend.
3.2 Preise gelten pro Unterkunft und Nacht für die gebuchte Belegung. Zusatzpersonen, Zusatzbetten, Reinigungsgebühren, Haustiergebühren und weitere Produkte werden gesondert ausgewiesen.
3.3 Zahlung nach Maßgabe des gebuchten Tarifs. The Haus darf jederzeit eine gültige Kreditkarte verlangen, verifizieren bzw. vorautorisieren.
3.4 Kreditkartengarantie: Der Gast ermächtigt The Haus, die Karte für den geschuldeten Betrag, Stornogebühren, No-Show sowie die Beträge nach Ziffer 10 zu belasten.
3.5 Rechnungen sofort fällig; Verzug nach §§ 286, 288 BGB.
3.6 Aufrechnung nur mit unbestrittenen oder rechtskräftig festgestellten Forderungen.
3.7 USt. auf Anzahlungen entsteht mit Vereinnahmung (§ 13 Abs. 1 Nr. 1 lit. a S. 4 UStG); Anzahlungsrechnung auf Wunsch, Verrechnung mit der Schlussrechnung.
4. AN- UND ABREISE, ZUTRITT, MELDEPFLICHT
4.1 Verfügbarkeit ab 16:00 Uhr; Räumung bis 12:00 Uhr. Danach Kosten gemäß Ziffer 10 sowie ggf. eine weitere Übernachtung.
4.2 Identitätsnachweis mit gültigem amtlichem Lichtbilddokument und Unterzeichnung des Meldescheins gemäß §§ 29, 30 BMG. Aufbewahrung ein Jahr. Ohne ordnungsgemäße Anmeldung kann der Zutritt verweigert werden.
4.3 Zutritt über digitale Schlüssel (Mobile Key / PIN) und/oder Schlüsselkarten. Zugangsdaten sind persönlich und nicht übertragbar. Verlust unverzüglich anzeigen; Ersatz gemäß Ziffer 10.
4.4 Keine Anreise bis 23:59 Uhr ohne Absprache → anderweitige Vergabe möglich; Preis bleibt nach Ziffer 6.4 geschuldet.
4.5 Nur die in der Reservierung genannten Personen dürfen übernachten. Mehrbelegung → Zutrittsverweigerung oder Berechnung nach Ziffer 10.
4.6 Minderjährige nur in Begleitung eines Erziehungsberechtigten oder mit nachgewiesener schriftlicher Zustimmung.
5. LEISTUNGEN, ÄNDERUNGEN, ERSATZUNTERKUNFT
5.1 Fotos und Beschreibungen sind illustrativ; geringfügige Abweichungen innerhalb einer Kategorie sind kein Mangel.
5.2 Überlassung ohne Verpflegung, sofern nicht ausdrücklich gebucht.
5.3 Änderungswünsche bedürfen der Zustimmung; Preisanpassung nach dem am Änderungstag gültigen Tarif; ggf. Behandlung als Stornierung mit Neubuchung.
5.4 Ersatzunterkunft: Bei Nichtverfügbarkeit aus nicht zu vertretenden Gründen gleichwertige oder höherwertige Unterkunft in Nürnberg; Mehrkosten und angemessene Transferkosten trägt The Haus. Gesetzliche Ansprüche bleiben unberührt.
6. RÜCKTRITT DES GASTES, STORNIERUNG, NO-SHOW
6.1 Rücktritt in Textform (reservations@the-haus.co), wirksam mit Zugang.
6.2 Es gelten die Stornobedingungen des gebuchten Tarifs. Non-Refundable: keine Rückerstattung.
6.3 Flexible Tarife: kostenfrei bis zur genannten Frist; danach Preis abzüglich ersparter Aufwendungen und anderweitiger Vermietung, alternativ die ausgewiesene Stornopauschale. Nachweis geringeren Schadens bleibt vorbehalten.
6.4 No-Show: Preis der gesamten Buchung, mindestens der ersten Nacht, nach Maßgabe von Ziffer 6.3.
6.5 OTA-Buchungen: dortige Storno-/Zahlungsbedingungen und Inkassomodell.
7. RÜCKTRITT UND KÜNDIGUNG DURCH THE HAUS
7.1 Möglich bei: (a) fehlender Anzahlung/Kreditkartengarantie trotz Nachfrist; (b) höherer Gewalt; (c) irreführenden/falschen Angaben zu Identität, Zahlungsfähigkeit, Aufenthaltszweck; (d) Gefährdung von Betrieb, Sicherheit oder Ansehen (unangemeldete Veranstaltungen, gewerbliche Nutzung, Untervermietung); (e) Verstoß gegen wesentliche Pflichten der Hausordnung.
7.2 Bei berechtigter Kündigung nach 7.1 (c)–(e) bleibt der Preisanspruch für den gesamten gebuchten Zeitraum bestehen; Schadensersatz bleibt unberührt.
8. HAUSORDNUNG UND PFLICHTEN DES GASTES
8.1 Pflegliche Behandlung; Einhaltung der Hausordnung.
8.2 Nachtruhe 22:00–07:00 Uhr.
8.3 Absolutes Rauchverbot in allen Innenräumen, einschließlich Treppenhäusern und Fluren, inkl. E-Zigaretten. Verstöße werden nach Ziffer 10.3 abgerechnet.
8.4 Partys/Veranstaltungen nur mit vorheriger schriftlicher Zustimmung.
8.5 Haustiere nur mit vorheriger Zustimmung in Textform und gegen Gebühr. Die Haustiergebühr beträgt 20 € pro Tier und Nacht; zulässig ist ein Hund je Unterkunft. Katzen und sonstige Tiere sind ausgeschlossen. Assistenzhunde im Sinne des § 12e BGG sind von Gebühr und Zustimmungserfordernis ausgenommen. Ohne vorherige Zustimmung mitgebrachte Tiere werden nach Ziffer 10.3 abgerechnet.
8.6 Keine mitgebrachten Elektrogeräte, offenes Feuer, Kerzen, Heizstrahler, Grillgeräte. Rauchmelder/Sicherheitseinrichtungen nicht manipulieren.
8.7 Haftung des Gastes nach §§ 280, 823 BGB, mehrere Gäste als Gesamtschuldner (§ 421 BGB).
8.8 Unverzügliche Anzeige von Schäden/Störungen; sonst Verlust von Minderungsansprüchen.
9. HAFTUNG VON THE HAUS
9.1 Unbeschränkt bei Leben, Körper, Gesundheit, Vorsatz, grober Fahrlässigkeit und nach ProdHaftG.
9.2 Bei leichter Fahrlässigkeit und Verletzung einer Kardinalpflicht: Begrenzung auf den vorhersehbaren, vertragstypischen Schaden. Im Übrigen ausgeschlossen.
9.3 Eingebrachte Sachen: §§ 701 ff. BGB; Wertsachen in den Safe.
9.4 Höhere Gewalt, Streik, behördliche Anordnungen, Ausfall von Strom/Wasser/Heizung/Aufzug/WLAN/Zugangssystemen: Haftung nur nach 9.1/9.2. Kurzfristiger WLAN-Ausfall begründet keine Minderung.
9.5 Wecken, Nachrichten, Post und Pakete: Sorgfalt eines ordentlichen Kaufmanns.
9.6 Fundsachen: Nachsendung auf Kosten und Gefahr des Gastes; Aufbewahrung drei Monate.
10. SCHADENSERSATZ, PAUSCHALIERTE ZUSATZKOSTEN UND BELASTUNG DER KREDITKARTE
10.1 Grundsatz. Der Gast haftet für Schäden an der Unterkunft, ihrer Ausstattung und den Gemeinschaftsflächen, die er oder Personen, denen er den Zutritt ermöglicht hat, schuldhaft verursachen, nach den gesetzlichen Vorschriften (§§ 280, 823 BGB). Mehrere Gäste einer Reservierung haften als Gesamtschuldner (§ 421 BGB). Die Haftung für den tatsächlich entstandenen Schaden ist der Höhe nach nicht begrenzt.
10.2 Umfang des Schadens. Ersatzfähig sind insbesondere Reparatur-, Ersatzbeschaffungs-, Fach- und Desinfektionsreinigungskosten, Kosten der Schadensfeststellung sowie der entgangene Gewinn für Nächte, in denen die Unterkunft infolge des Schadens nicht vermietbar ist (§ 252 BGB), berechnet nach dem durchschnittlichen Nettozimmerpreis der betroffenen Kategorie in den letzten 30 Tagen.
10.3 Pauschalierte Zusatzkosten. Für die nachstehenden Sachverhalte berechnet The Haus die folgenden Beträge als pauschalierten Schadensersatz:

Dem Gast bleibt ausdrücklich der Nachweis vorbehalten, dass ein Schaden überhaupt nicht oder wesentlich niedriger als die Pauschale entstanden ist. The Haus bleibt der Nachweis eines höheren Schadens vorbehalten. Die Pauschalen nach 10.3 werden auf einen nach 10.1/10.2 geltend gemachten höheren Schaden angerechnet; eine Kumulierung findet nicht statt.
10.4 Belastung der Kreditkarte. Der Gast ermächtigt The Haus, die hinterlegte Kreditkarte mit den Beträgen nach Ziffer 10.1 bis 10.3 zu belasten. The Haus informiert den Gast vor der Belastung in Textform unter Angabe des Sachverhalts, des Betrags und der Berechnungsgrundlage und übermittelt die vorliegenden Nachweise (Lichtbilder, Kostenvoranschläge, Rechnungen). Ist die endgültige Höhe noch nicht bezifferbar, erfolgt zunächst eine Information dem Grunde nach und anschließend die Abrechnung. Die Einzelheiten der Datenverarbeitung ergeben sich aus der Datenschutzerklärung.
10.5 Dokumentation. The Haus ist berechtigt, Schäden und Verstöße durch Lichtbilder und Protokolle zu dokumentieren und diese Unterlagen zur Geltendmachung von Ansprüchen sowie gegenüber Versicherungen und Behörden zu verwenden.
10.6 Kaution. The Haus kann in Einzelfällen — insbesondere bei Gruppenbuchungen, Langzeitaufenthalten oder erhöhtem Risiko — eine Kaution oder eine Vorautorisierung von bis zu 500 € pro Aufenthalt verlangen. Die Freigabe erfolgt binnen 7 Tagen nach Abreise, soweit keine Ansprüche bestehen.
11. DATENSCHUTZ
11.1 Verarbeitung nach DSGVO und BDSG; Rechtsgrundlagen Art. 6 Abs. 1 lit. b, c und f DSGVO. 11.2 Einzelheiten und Betroffenenrechte: www.the-haus.co/privacy-policy 11.3 Kreditkartendaten ausschließlich über PCI-DSS-zertifizierte Zahlungsdienstleister.
12. GEISTIGES EIGENTUM UND NUTZUNG DER WEBSITE

13. REKLAMATIONEN
13.1 Mängel unverzüglich vor Ort anzeigen. 13.2 Nachträgliche Reklamationen binnen 20 Werktagen nach Abreise in Textform an info@the-haus.co. 13.3 Verbraucherschlichtung: The Haus ist zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle weder verpflichtet noch bereit (§ 36 VSBG).
14. SCHLUSSBESTIMMUNGEN
14.1 Änderungen bedürfen der Textform. 14.2 Individuell schriftlich vereinbarte Sonderbedingungen gehen vor. 14.3 Salvatorische Klausel. 14.4 Anwendbares Recht: deutsches Recht unter Ausschluss des UN-Kaufrechts; zwingende Verbraucherschutzvorschriften des Aufenthaltsstaats bleiben unberührt. 14.5 Erfüllungsort und Gerichtsstand Nürnberg, ausschließlich gegenüber Kaufleuten, juristischen Personen des öffentlichen Rechts und Gästen ohne inländischen Gerichtsstand. Für Verbraucher gelten die gesetzlichen Gerichtsstände.

This is a courtesy translation. In the event of any discrepancy, the German version of these Terms and Conditions (Allgemeine Geschäftsbedingungen) shall prevail.
1. SCOPE AND FORMATION OF THE CONTRACT
1.1 These Terms govern the provision of apartments and rooms for accommodation purposes, as well as all further services and deliveries provided by The Haus to the Guest in connection therewith.
1.2 The accommodation contract is formed when The Haus accepts the Guest's booking request. Confirmation may be given in text form (e-mail). For bookings made through online travel agencies (OTAs), the rate and cancellation conditions displayed there apply in addition; as between the Guest and The Haus these Terms prevail, except where mandatory platform rules override them.
1.3 The Haus provides accommodation services only, together with directly related ancillary services. The Haus neither organises nor brokers package travel or linked travel arrangements within the meaning of §§ 651a et seq. of the German Civil Code (BGB). Transport, excursions or other third-party services are, if at all, provided solely as an intermediary for the respective supplier, who in that case becomes the Guest's contracting party.
1.4 Subletting or re-letting the Accommodation, and any use for purposes other than accommodation, require the prior written consent of The Haus.
1.5 Deviating terms of the Guest do not become part of the contract, even if not expressly objected to.
1.6 Incorporation. These Terms are made available to the Guest during the booking process before the booking request is submitted, and again at registration on arrival, and are permanently available and downloadable at www.the-haus.co/terms.
2. NO RIGHT OF WITHDRAWAL
For contracts on the provision of accommodation for purposes other than residential purposes where the contract provides for a specific date or period of performance, there is no statutory right of withdrawal (§ 312g para. 2 no. 9 BGB). Only the cancellation conditions of the booked rate apply (Section 6).
3. PRICES, PAYMENT, SECURITY
3.1 Prices are stated in Euro and include statutory VAT (accommodation currently 7%, ancillary services and additional products currently 19%). Should statutory tax rates change, or statutory charges be introduced or amended, prices change accordingly.
3.2 Prices apply per Accommodation per night for the booked occupancy. Additional persons, extra beds, cleaning fees, pet fees and other booked products are charged separately and shown as such.
3.3 Payment is due according to the booked rate: at the time of booking, before arrival, or on arrival. The Haus is entitled at any time to require a valid credit card to secure the contract and to verify or pre-authorise it.
3.4 Credit card guarantee: By providing credit card details, the Guest authorises The Haus to charge the card for the amount contractually owed, for cancellation fees, for the amount due in the event of non-arrival (no-show), and for the amounts set out in Section 10.
3.5 Invoices are due immediately without deduction. In the event of late payment, statutory provisions apply (§§ 286, 288 BGB).
3.6 The Guest may only set off claims that are undisputed or have been finally determined by a court.
3.7 VAT on advance payments becomes due upon receipt of the funds (§ 13 para. 1 no. 1 lit. a sentence 4 UStG); on request the Guest receives an advance invoice, which is offset against the final invoice on departure.
4. ARRIVAL, DEPARTURE, ACCESS, REGISTRATION DUTY
4.1 Booked Accommodation is available to the Guest from 16:00 on the day of arrival and must be vacated by 12:00 on the day of departure. Thereafter The Haus may charge the amounts set out in Section 10 and, where applicable, a further night.
4.2 On arrival the Guest must prove their identity with a valid official photo ID and complete and sign the registration form (Meldeschein) pursuant to §§ 29, 30 of the German Federal Registration Act (BMG). The Haus is legally required to retain the registration form for one year. Accommodation without proper registration is not permitted; in such case The Haus is entitled to refuse access.
4.3 Access is provided via digital keys (mobile key / PIN) and/or key cards. Access credentials, PINs and cards are personal and non-transferable; passing them to third parties is prohibited. Loss of a card must be reported immediately; replacement is charged pursuant to Section 10.
4.4 If the Guest does not arrive by 23:59 on the day of arrival and no later arrival has been agreed, The Haus may re-let the Accommodation after that time; the agreed price remains payable in accordance with Section 6.4.
4.5 Only the persons named in the reservation may stay overnight in the Accommodation. If more persons arrive than booked, The Haus may refuse access or charge for the additional occupancy pursuant to Section 10.
4.6 Minors may only be accommodated when accompanied by a legal guardian or with that guardian's documented written consent.
5. SERVICES, CHANGES, ALTERNATIVE ACCOMMODATION
5.1 Photographs and descriptions on the website and on booking platforms are illustrative; minor differences between individual units of the same category do not constitute a defect.
5.2 Accommodation is provided without meals unless expressly booked otherwise.
5.3 Change requests by the Guest (dates, category, number of persons) require the consent of The Haus and may result in a price adjustment at the rate applicable on the date of the change. A change may be treated as a cancellation and rebooking where the original rate so provides.
5.4 Alternative accommodation: If the booked Accommodation is unavailable for reasons not attributable to The Haus, The Haus may provide the Guest with equivalent or superior accommodation in the same or a comparable property in Nuremberg. Any additional cost and reasonable transfer costs are borne by The Haus. Further statutory claims of the Guest remain unaffected.
6. CANCELLATION BY THE GUEST, NO-SHOW
6.1 Cancellation by the Guest must be made in text form (e-mail to reservations@the-haus.co) and takes effect upon receipt by The Haus.
6.2 The cancellation conditions of the booked rate apply, as displayed during the booking process and stated in the booking confirmation. Non-refundable rates carry no entitlement to a refund.
6.3 For flexible rates, cancellation is free of charge until the deadline stated in the confirmation. Thereafter The Haus is entitled to the agreed price less expenses saved and less any income from re-letting; alternatively The Haus may charge the cancellation fee set out in the rate. The Guest is free to prove that no damage, or substantially lower damage, has occurred.
6.4 No-show: If the Guest does not arrive and has not cancelled, the price of the entire booking — but at least the price of the first night — is charged in accordance with Section 6.3.
6.5 For OTA bookings, the cancellation and payment terms bindingly agreed on that platform apply; refunds are processed according to the platform's collection model.
7. WITHDRAWAL AND TERMINATION BY THE HAUS
7.1 The Haus may withdraw from the contract or terminate it for cause where: a) an agreed advance payment or credit card guarantee is not provided despite a grace period; b) force majeure or other circumstances not attributable to The Haus make performance impossible; c) the booking was made on the basis of misleading or false statements of material facts (identity, solvency, purpose of stay); d) The Haus has reasonable grounds to believe that the use may jeopardise the operation, the security or the reputation of The Haus (in particular undeclared events, commercial use, subletting); e) the Guest breaches material obligations under Section 8 (House Rules) and continuation of the stay is unreasonable.
7.2 Where termination is justified under Sections 7.1 (c)–(e), The Haus retains its claim to the agreed price for the entire booked period; claims for damages remain unaffected.
8. HOUSE RULES AND GUEST OBLIGATIONS
8.1 The Guest must treat the Accommodation with care and comply with the house rules as displayed or made available digitally.
8.2 Quiet hours apply from 22:00 to 07:00. Noise disturbing other guests or neighbours must be avoided.
8.3 No smoking: Smoking is strictly prohibited in all indoor areas, including stairwells and corridors (e-cigarettes included). Breaches are charged pursuant to Section 10.3.
8.4 Parties and events of any kind are prohibited without the prior written consent of The Haus.
8.5 Pets may only be brought with prior consent in text form and against payment of the pet fee of €20 per animal per night; one dog per Accommodation is permitted. Cats and other animals are not accepted. Assistance dogs within the meaning of § 12e BGG are exempt from both the fee and the consent requirement. Animals brought without prior consent are charged pursuant to Section 10.3.
8.6 Guest-supplied electrical appliances, open flames, candles, portable heaters and barbecues are prohibited inside the Accommodation. Smoke detectors and safety devices must not be covered, removed or tampered with.
8.7 The Guest is liable under the statutory provisions (§§ 280, 823 BGB) for all damage caused by the Guest, their companions, or third parties admitted by them. Where a booking covers several guests, they are liable as joint and several debtors (§ 421 BGB).
8.8 Damage and malfunctions must be reported to The Haus without delay so that remedy can be provided. If the Guest culpably fails to report, claims for reduction are excluded to that extent.
9. LIABILITY OF THE HAUS
9.1 The Haus is liable without limitation for damage arising from injury to life, body or health caused by a breach of duty by The Haus, its legal representatives or vicarious agents, as well as for intent and gross negligence, and under the German Product Liability Act.
9.2 In the case of slight negligence in breach of a material contractual obligation (cardinal obligation), liability is limited to the foreseeable damage typical for this type of contract at the time the contract was concluded. Otherwise liability for slight negligence is excluded.
9.3 Liability for property brought in is governed by §§ 701 et seq. BGB. Money, securities and valuables should be kept in the safe provided, where available; The Haus expressly recommends this.
9.4 For disruptions caused by force majeure, strike, official orders, or failure of electricity, water, heating, lift, Wi-Fi or access systems, The Haus is liable only in case of fault in accordance with Sections 9.1 and 9.2. A short-term Wi-Fi outage does not give rise to a claim for price reduction.
9.5 Wake-up calls, message and mail handling and parcel acceptance are carried out with the diligence of a prudent business person; liability for loss is assumed within the scope of Sections 9.1/9.2.
9.6 Lost property is forwarded on request at the Guest's cost and risk and is kept for three months.
10. DAMAGES, LIQUIDATED ADDITIONAL COSTS AND CHARGING OF THE CREDIT CARD
10.1 Principle. The Guest is liable under the statutory provisions (§§ 280, 823 BGB) for damage to the Accommodation, its contents and the common areas caused culpably by the Guest or by persons to whom the Guest has granted access. Where a reservation covers several guests, they are liable as joint and several debtors (§ 421 BGB). Liability for the damage actually incurred is not subject to any upper limit.
10.2 Scope of the damage. Recoverable heads of damage include, in particular, repair costs, replacement costs, specialist and disinfection cleaning costs, the cost of assessing the damage, and the loss of profit for nights during which the Accommodation cannot be let as a result of the damage (§ 252 BGB), calculated at the average net room rate for the affected category over the preceding 30 days.
10.3 Liquidated additional costs. For the situations listed below, The Haus charges the following amounts as liquidated damages (pauschalierter Schadensersatz):

The Guest expressly remains free to prove that no damage at all, or substantially lower damage, has been incurred. The Haus remains free to prove higher damage. Amounts under 10.3 are credited against any higher claim asserted under 10.1/10.2; they are not cumulative.
10.4 Charging of the credit card. The Guest authorises The Haus to charge the credit card on file with the amounts arising under Sections 10.1 to 10.3. Before charging, The Haus notifies the Guest in text form stating the facts, the amount and the basis of calculation, and provides the available evidence (photographs, quotations, invoices). Where the final amount cannot yet be quantified, The Haus first notifies the Guest of the claim in principle and settles the account thereafter. Details of the related data processing are set out in the privacy policy.
10.5 Documentation. The Haus is entitled to document damage and breaches by means of photographs and written records and to use such material to assert claims and in dealings with insurers and public authorities.
10.6 Security deposit. In individual cases — in particular group bookings, long stays or elevated risk — The Haus may require a deposit or a pre-authorisation of up to €500 per stay. Release follows within 7 days of departure where no claims exist.
11. DATA PROTECTION
11.1 The Haus processes the Guest's personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). The legal bases are in particular Art. 6(1)(b) GDPR (performance of the contract), Art. 6(1)(c) GDPR (legal obligations, including registration and retention duties) and Art. 6(1)(f) GDPR (legitimate interests, including fraud prevention).
11.2 Details on purposes, recipients, retention periods and data subject rights (access, rectification, erasure, restriction, portability, objection, and complaint to a supervisory authority) are set out in the privacy policy at www.the-haus.co/privacy-policy.
11.3 Credit card data is processed exclusively via certified payment service providers (PCI-DSS) and is not stored in plain text by The Haus.
12. INTELLECTUAL PROPERTY AND USE OF THE WEBSITE
12.1 All content of the website and the booking engine (text, images, software, trademarks, logos) is protected by copyright and trademark law. Any use beyond the contractual booking — in particular reproduction, modification, distribution or making available to the public — is prohibited without prior written consent.
12.2 Access to the website and booking engine by automated means (scraping, crawlers, scripts) is prohibited.
12.3 The Guest is responsible for the confidentiality of their user account credentials and must report any unauthorised use without delay.
13. COMPLAINTS
13.1 Defects must be reported on site to The Haus without delay so that remedy can be provided.
13.2 Subsequent complaints must be submitted in text form to info@the-haus.co no later than 20 working days after departure. Statutory limitation periods remain unaffected.
13.3 Online dispute resolution / consumer arbitration: The Haus is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
14. FINAL PROVISIONS
14.1 Amendments and additions to this contract require text form. Unilateral changes by the Guest are invalid.
14.2 Precedence: Special conditions individually agreed in writing take precedence over these Terms.
14.3 Severability: Should individual provisions of these Terms be invalid or unenforceable, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the applicable statutory provisions.
14.4 Governing law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.
14.5 Place of performance and jurisdiction is Nuremberg. Nuremberg is the exclusive place of jurisdiction where the Guest is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany. For consumers, the statutory places of jurisdiction apply.
GUEST CONFIRMATION
The Guest confirms having read, understood and accepted these Terms and Conditions and the House Rules, and having taken note of the privacy policy. The Guest expressly confirms having taken note of Section 2 (no right of withdrawal), Section 6 (cancellation conditions) and Section 10 (damages and liquidated additional costs).
